Terms of Service

Note: Prio is currently operated as a pre-incorporation project. A formal legal entity is in the process of being established in Spain. These Terms will be updated with the registered company details once incorporation is complete. All obligations and limitations described below are binding and enforceable.

1. Service Description

Prio is a real-time property alert service. We monitor publicly available listing data from real estate platforms (including but not limited to Idealista, Fotocasa, Badi, and others) and send notifications to users when new listings match their defined search criteria.

Prio is a notification service. We do not act as a real estate agent, broker, or intermediary. We do not verify listings, negotiate rents, or participate in rental transactions. Any transaction you enter into based on a Prio alert is solely between you and the listing party.

2. Acceptance of Terms

By using Prio — including interacting with our Telegram bot, visiting our website, or subscribing to a paid plan — you agree to these Terms. If you do not agree, do not use the service.

3. Eligibility

You must be at least 16 years old to use Prio. By using the service, you represent that you meet this requirement.

4. Account and Access

• Access to Prio is provided through Telegram. You are responsible for maintaining the security of your Telegram account.
• You may not share your Prio subscription with others or allow others to use your account for their benefit.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Free and Paid Plans

• Free plan: alerts at standard speed, limited searches. May be modified or discontinued at any time.
• Paid plans: priority alerts, unlimited searches, additional features as described on our pricing page. Billed weekly or monthly depending on the plan.
• Prices may change with 30 days' notice. Existing subscribers will be honored at their current rate until the end of their billing period.
• All paid plans can be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

6. B2B Plans — City Slot Exclusivity

B2B plans (Agent Solo, Agency, Premium) include city slot exclusivity — a limited number of B2B subscribers per city. This exclusivity is provided on a best-effort basis. We reserve the right to adjust slot limits if necessary for business reasons, with 60 days' notice to affected subscribers.

7. Limitation of Liability

This is important — please read carefully.

• Prio provides notifications based on publicly available data. We do not guarantee the accuracy, completeness, or availability of any listing.
• We do not verify whether listings are genuine, whether apartments are available, or whether landlords/agents are legitimate. Always verify listings independently before making any payment or commitment.
• Approximately 37% of listings detected by our system are "ghost listings" — listings that briefly appear but are removed before becoming publicly visible. This is a known characteristic of the platforms we monitor and is not a defect in our service.
• We are not responsible for any loss, damage, or expense arising from your reliance on a Prio notification, including but not limited to rental scams, fraudulent listings, failed transactions, or missed opportunities.
• Our total liability to you for any claims arising from the use of Prio is limited to the fees you have paid us in the 3 months preceding the claim.
• We provide the service "as is" and "as available" without warranties of any kind, express or implied.

8. Service Availability

• We aim for high availability but do not guarantee uninterrupted service. Monitoring may be temporarily interrupted for maintenance, platform changes, or technical issues.
• Real estate platforms may change their systems at any time, which may temporarily or permanently affect our ability to detect new listings. We will make reasonable efforts to adapt but cannot guarantee continuous coverage of any specific platform.
• Alert delivery depends on Telegram's infrastructure. We are not responsible for delays or failures in Telegram's notification system.

9. Acceptable Use

You agree not to:

• Use Prio for any unlawful purpose
• Resell, redistribute, or commercially exploit Prio alerts without our written consent
• Attempt to reverse-engineer, decompile, or extract the technical methods used by Prio
• Use automated tools to interact with our Telegram bot beyond normal usage
• Use Prio data to build a competing service

10. Intellectual Property

The Prio name, logo, website content, and the technical systems underlying our service are our intellectual property. Listing data belongs to the respective platforms and landlords/agents who created it — we claim no ownership over listing content.

11. Governing Law

These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Barcelona, Spain. For EU consumers, mandatory consumer protection laws of your country of residence apply where they provide greater protection.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via Telegram or on our website with at least 30 days' notice. Continued use after changes take effect constitutes acceptance.
